Winerz Mobile App

Please read these Terms and Conditions (« Terms ») carefully before using the Winerz mobile application (« App »). By accessing or using the App, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, you may not access or use the App.

1. Eligibility

1.1 You must be at least 18 years old to participate in the cash prize tournaments available in the Winerz App.
1.2 The App is available to users in eligible countries where participation in such activities is legally allowed. It is your responsibility to ensure compliance with your local laws and regulations.

2. Free Entries and Cash Prize Tournaments

2.1 Winerz App offers free entries for cash prize tournaments.
2.2 You may participate in the cash prize tournaments by using the free entries earned through various methods, including watching rewarded videos and referring friends.
2.3 Cash prizes are awarded to winners of the tournaments based on their performance and ranking.
2.4 The availability and frequency of cash prize tournaments may vary and are subject to change at the discretion of Winerz.
2.5 Players may withdraw their winnings to their bank account, subject to the following conditions:
- Players must verify their identity through Veriff before initiating a withdrawal.
- A minimum of 5 Euros in winnings must be accumulated to request a withdrawal.
- Players are required to provide accurate bank account information to complete the withdrawal process.
- A 10% fee is applied per withdrawal.
2.6 Withdrawal processing times are as follows:
- For standard players, withdrawals are processed within one month.
- For Gold Pass subscribers, withdrawals are processed within 48 hours, though delays may occur depending on the player’s bank.
2.7 Winerz is not responsible for delays caused by incorrect bank information provided by the player or by the player’s financial institution.
2.8 Winnings must be withdrawn within 6 months from the date they are awarded. Unclaimed winnings after this period may be forfeited at Winerz’s discretion, with no further obligation to the player.
2.9 You are solely responsible for reporting and paying any applicable taxes on winnings as required by your local laws. Winerz does not provide tax advice or withhold taxes on your behalf unless required by law.
2.10 Winnings are paid in Euros (€). If your bank account uses a different currency, conversion rates and fees may apply as determined by your financial institution.
2.11 Winerz reserves the right to block or withhold withdrawals from accounts suspected of cheating, hacking, or violating the App’s rules.

3. Fair Play and Conduct

3.1 Winerz promotes fair play and expects all users to abide by the rules and regulations set forth in the App.
3.2 Any form of cheating, hacking, or exploiting the App’s features is strictly prohibited.
3.3 Winerz has implemented a strong anti-cheating system to ensure fair competition and protect the integrity of the tournaments.
3.4 Winerz reserves the right to take appropriate action, including account suspension or termination, against users found engaging in fraudulent activities.

4. Privacy and Data Collection

4.1 Winerz collects and processes personal information in accordance with its Privacy Policy.
4.2 By using the App, you consent to the collection, storage, and use of your personal information as described in the Privacy Policy.
4.3 By creating an account with Winerz, you consent to receive marketing and promotional emails from us. You can opt-out of these communications at any time.

5. Intellectual Property

5.1 All intellectual property rights, including copyrights and trademarks, related to the App and its content are owned by Winerz.
5.2 You may not use, reproduce, modify, distribute, or exploit any of the App’s content without prior written permission from Winerz.

6. Limitation of Liability

6.1 Winerz shall not be held liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or related to the use of the App.
6.2 Winerz does not guarantee the availability, accuracy, or reliability of the App and its content.

7. « Silver Pass » and « Gold Pass » Subscriptions

7.1 Subscription Description – The « Silver Pass » and « Gold Pass » are monthly subscription options that provide users with additional features including access to premium tournaments, additional energy refills, priority customer support, and faster processing of withdrawals.
7.2 Free Trial Period – A 3-day free trial period for new users, unless otherwise specified. The subscription will automatically renew at the applicable monthly rate unless canceled before the trial ends.
7.3 Pricing and Billing – Prices are displayed within the app at the time of purchase and may vary depending on region and currency. Billed through iTunes or Google Play. All subscriptions automatically renew unless canceled.
7.4 Automatic Renewal and Cancellation – Subscriptions automatically renew each month. Users can manage and cancel via App Store or Google Play settings.
7.5 Subscription Changes – Users may upgrade or downgrade. Changes take effect at the next billing period.
7.6 Privacy Policy and Data Protection – Personal data collected is subject to our Privacy Policy.
7.7 Changes to Pricing and Terms – Winerz reserves the right to change prices, subscription terms, and benefits at any time with advance notification.

8. Modifications and Termination

8.1 Winerz reserves the right to modify, suspend, or terminate the App or any part thereof at any time without prior notice.
8.2 Winerz may also update or modify these Terms at its discretion. Continued use of the App after any modifications constitutes acceptance of the updated Terms.

9. Governing Law

9.1 These Terms shall be governed by and construed in accordance with the laws of Estonia, without regard to its conflict of law principles.

By using the Winerz mobile app, you agree to comply with these Terms and any additional rules or guidelines provided within the App. If you do not agree with any part of these Terms, please refrain from using the App.
